1. Designated Agent

2. Submitting a notice of claimed infringement

To be effective, a notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed;
  3. Identification of the material claimed to be infringing, with enough information to let us locate it — a direct URL is best;
  4. Your name, mailing address, telephone number, and email address;
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Before sending a notice, please consider whether the use is a fair use. Under 17 U.S.C. § 512(f), anyone who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

We will respond to valid notices expeditiously, and will notify the person who posted the material that it has been removed.

3. Counter-notification

If your content was removed and you believe it was removed as a result of mistake or misidentification, you may send us a counter-notification containing:

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and the location where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed as a result of mistake or misidentification;
  4. Your name, mailing address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located — or, if your address is outside the United States, the Central District of California — and that you will accept service of process from the person who submitted the original notice.

We will forward your counter-notification to the person who submitted the original notice. We may restore the removed material in 10 to 14 business days after receiving your counter-notification, unless we first receive notice that the complaining party has filed a court action seeking to restrain you from engaging in the infringing activity.

4. Repeat infringer policy

We terminate the accounts of repeat infringers in appropriate circumstances.

A valid, uncontested takedown notice against content you posted counts as a strike. Two strikes result in a formal warning. Three strikes result in permanent termination of your account and of your ability to submit content. We may terminate an account sooner in cases of blatant or large-scale infringement. Strikes are removed after 24 months.

5. Trademark and other rights

For claims involving trademarks, rights of publicity, or other intellectual property rights, contact legal@eventvault.com.

6. Requesting removal of your image

If you appear in a photograph on EventVault and would like it removed, email privacy@eventvault.com with a link. Requests involving a person under 18 are honored within 48 hours, no reason required. All other requests are reviewed promptly and in good faith.
